Subject matter of the contract
Además sells you the ordered goods exclusively under the following General Terms and Conditions (GTC), subject to special agreements, which apply in particular to the purchase of special products in our online store.

Conclusion of contract
You can order in the online store, by telephone, fax or post. The contract between you and Además is concluded on the basis of your order and the acceptance of the order by Además. You will be informed of the acceptance of your order by e-mail. If you order in the online store, you will receive an automatic order confirmation. This merely confirms the completion of the electronic ordering process; the contract is only concluded when Además expressly accepts the order. Además can also reject an order without giving reasons.

Delivery time
Además usually ships items in stock no later than the next working day. Items that are not in stock at Además will be dispatched within 2 days of receipt from the supplier.

Terms of delivery
Además delivers the ordered goods to the address you specify within Switzerland and Liechtenstein. As a rule, delivery is made by Swiss Post by means of a non-registered parcel. Además will charge you CHF 9.00 for shipping, with the exception of parcels over 10 kg and bulky goods, for which an amount corresponding to the actual additional costs will be charged. Orders with a value of CHF 100.00 or more are delivered free of charge, with the exception of furniture. Además reserves the right to choose a different delivery method for furniture shipments in individual cases. Shipment by registered parcel and the conclusion of transport insurance will only take place on your express instructions. We send our deliveries by Swiss Post.

With reference to Art. 185 para. 2 CO, Además states that the benefit and risk for the ordered goods are transferred to the buyer after Además has posted the parcel at the post office. If damage occurs during transportation to you, you must contact the post office immediately upon receipt of the parcel and report the damage to the post office. The products offered in this store will be delivered within seven working days, provided they are in stock. For orders of furniture and garden furniture, we will inform you individually about the expected delivery time when we accept the order. For custom-made products, the conditions in our documentation and our order confirmations apply.

Terms of payment
All prices are quoted in Swiss francs (CHF) including VAT. The ordered goods are usually delivered against invoice. The invoice amount is payable without deductions within 10 days. Además reserves the right to deliver orders only against prepayment. This is the rule for goods worth more than CHF 300.00 and for online orders. For custom-made products, the conditions in our documentation and our order confirmations apply. In the event of late payment, Además is entitled to claim the costs of reminders and further legal action. If a payment that appears to have been made is later canceled, the customer must compensate Además for any additional expenses.

Retention of title
The delivered goods remain the property of Además until the purchase price has been paid in full. Además is entitled to register a corresponding retention of title. If a customer defaults on payment, Además has the right to withdraw from the purchase agreement.

Right of return
You must check the ordered goods for defects and completeness immediately upon receipt and report any defects to Además in writing or by e-mail within five days of receipt of the goods. Defects reported later cannot be taken into account. Además will contact you immediately upon receipt of the complaint in order to find a solution for you. Además is entitled to exchange the defective goods for goods free of defects or for a shopping voucher in the amount of the purchase price of the defective goods. Returns without our written consent will not be accepted. The return of ordered and defect-free goods is excluded in principle.

Only unused and originally packaged products ordered in the online store can be returned. In this case, the ordered product must be returned to Además within 14 days of delivery to the customer. The customer bears the costs of the return shipment. In this case, the return shipment must be sent to “Además, Garnmarkt 1, 8400 Winterthur”.

Data protection
Además processes customers’ personal data in strict compliance with the applicable data protection legislation. Visits to our online store are recorded and we reserve the right to analyze the data collected. However, all data is treated with absolute confidentiality and is used to process orders, for further customer support and for statistical purposes. This also includes marketing measures such as physical or electronic circulars. Customer data is only made accessible to third parties to the extent necessary for the processing of orders and payment transactions. For online orders in particular, this also includes the transfer of payment data to financial service providers.

Place of performance, place of jurisdiction and applicable law
The place of performance for our deliveries of goods and for your purchase price payments is our registered office in Winterthur. These GTC and the contracts concluded on the basis of these GTC are subject to Swiss law. With the acceptance of your order by Además, a purchase contract within the meaning of Art. 184 ff. of the Swiss Code of Obligations is concluded. Unless otherwise stipulated in these provisions, the provisions of the Swiss Code of Obligations shall apply. The place of jurisdiction is 8400 Winterthur.

Final provisions
The contractual relationship shall be governed by Además’ GTC in force at the time the contract is concluded. These shall apply in particular even if they differ from those of the customer. Should individual provisions of these GTC be or become invalid, this shall not affect the legal validity of the remaining provisions.
